General Terms and Conditions (GTC)

§1 Scope

These terms and conditions apply to all contracts between Yacht Consulting Henning (hereinafter “Consultant”) and its clients (hereinafter “Client”), unless otherwise agreed in writing.

§2 Subject of the Contract

The subject of the contract is the provision of consulting services in the yacht sector (e.g., purchase consulting, project management, surveys). The Consultant owes professional advice, but not a specific economic success.

§3 Conclusion of the Contract

A contract is concluded through written confirmation of an offer or by signing a separate consulting agreement.

§4 Fees and Payment Terms

The fees agreed in the individual offer apply. Unless otherwise agreed, invoices are payable within 14 days without deduction. All prices are subject to statutory VAT.

§5 Liability

  1. The Consultant is liable only for intent and gross negligence.
  2. Liability for slight negligence is limited to the typically foreseeable damage and in amount to the coverage sum of the Consultant’s professional liability insurance.
  3. The Consultant assumes no liability for the accuracy of information provided by third parties (e.g., shipyards, sellers).

§6 Confidentiality and Data Protection 

The Consultant undertakes to maintain confidentiality regarding all business matters of the Client that become known in the course of the engagement.

§7 Final Provisions / Jurisdiction

The law of the Federal Republic of Germany shall apply. The place of jurisdiction is the Consultant’s registered office, provided the Client is a merchant.
